RULES
The "Live Show" Contest (the "Contest") is organized by ETERMAX S.A., domiciled at Dr. Luis Bonavita 1294, Of. 1701, Montevideo, Uruguay (hereinafter "Etermax").
No payment or purchase is required to enter or win the Contest. In order to be able to enter to the Contest, the mobile app "Trivia Crack" (the "App") must be downloaded. By downloading the App and entering the Contest, you agree to these rules (“Rules”) and the following Terms of Service https://www.etermax.com/en/terms and Privacy Policy http://www.etermax.com/en/privacy/.
Please refrain from entering this Contest if you do not agree with our Terms of Service, Privacy Policy and/or Rules.
The geographical scope of this Contest is the whole territory of the United States of America (the "Territory"), and every individual residing within the limits of the Territory shall be the only one able to enter it. If you reside outside the limits of the Territory you will not be allowed to enter the Contest and granted any Prize (as further defined below). You understand and accept that, if you were to win a Game (as further defined below), but do not reside within the Territory, you shall not be granted any Prize.
The Contest will be void where prohibited or restricted by law or where other requirements would be required but have not been met.
All national, federal, state, departmental, municipal and/or local laws shall be applicable. The Contest shall be governed by these Rules:
1. Eligibility
Participation is open only to legal residents of the United States who are at least 18 years old (or the age of majority in their state of residence, if higher). Entrants may be required to provide proof of age if necessary under state law. Do not enter the Contest if you are prohibited to use the App or to enter the Contest by any applicable national, federal, state, departmental, municipal and or local law.
You shall be able to enter the Contest with only one of your accounts of the App. Moreover, each App account can only belong, be used and controlled by one individual. That is, you cannot jointly own accounts. Etermax reserves the right to suspend or terminate any or all of your accounts and terminate, deny or cancel the awarding of any Prizes if it determines at its own discretion that you “co-own” accounts, participated with more than one account, or breached any of what is stated above.
Employees, directors, agents, and contractors (collectively, "Employees") of Etermax and its respective affiliates, subsidiaries, and advertising and promotion agencies and any other party involved in setting up or operating this Contest are not eligible to win the Prize. While the Employee is employed or engaged by Etermax, all of the people living in the same address of the Employees’, shall not be eligible to win any Prize. This shall only apply as long as the Employee is under a labor or commercial relationship with Etermax. This restriction shall continue for six months following the Employee’s last day of the labor or commercial relationship.
If you enter a Game and do not meet the previous requirements, you will not be eligible to win a Prize for that Game. Etermax reserves the right to verify your eligibility before, during, or after the Contest.
2. Compliance with applicable law
It is your responsibility to comply with laws of your country or jurisdiction regarding your participation.
You acknowledge that due to certain laws and regulations that may apply to you, Etermax may not be able to grant you any Prize. Therefore, if you happen to win a Game in the Contest, please be aware that you may not be able to receive any Prize at all from Etermax. By participating in this Contest, you accept the risks of winning, but not being able to receive a Prize. No in-app purchase or payment provides any competitive advantage in contests with cash prizes. The outcome of each Game depends on knowledge, speed, and skill; chance plays no role in determining winners. If a Winner resides in a jurisdiction where the Contest is restricted or prohibited by law, Etermax may withhold, cancel, or reassign the Prize at its sole discretion.
3. Entry period for each game of the Contest:
Each Game of the Contest will be announced through the App 5 minutes before it starts. You may join the Game at any time while it is live. If you join while a question is being answered, you will enter the lobby and automatically start participating from the next question. Once you are playing, you can choose to answer each question or not. If you do not answer within the allotted time, you will receive a timeout and score 0 points for that question. For the questions you missed for entering late, you shall be awarded 0 points.
4. Access and game mode for each Game
No purchase or payment is necessary to participate in the Contest or to access each Game. To enter the Game, you must complete the following steps:
- Download or open the App downloaded through the Apple Store or Google Play on your mobile device.
- Click on “Live Show”. If you have opted-in for notifications from the App, you will receive a notification 5 minutes before the Game starts.
- Each Game consists of 12 questions with 4 possible answers each ("Game"). All Entrants will be asked the same questions. Questions will be delivered one at a time, in real time.
- Every Entrant will have 10 seconds to answer each question. If you answer correctly, you will move on to the next question. If you get the answer wrong, you will receive a timeout and score 0 points for that question.
- "Winning" or "losing" will not be left to chance in any case, but will depend solely on the skill and speed of the Entrants, who must answer a series of questions correctly. In this version of the event, the Winners will be the Entrants who reach the podium (positions 1, 2, and 3) based on their total score. Points are awarded for each correct answer, and the number of points varies depending on how quickly the Entrant responds. Although two Entrants may answer correctly, they may not receive the same score, since the server automatically assigns a bonus to those who respond faster within the 10-second time limit.
- Etermax may track scores, response times, and other gameplay metrics to verify that Winners are determined solely by skill and not by chance or automated means.
By downloading the App, you agree that any information provided by you or collected by Etermax in connection with the Contest may be used by Etermax in accordance with its Privacy Policy http://www.etermax.com/en/privacy/ and its Terms of Service http://www.etermax.com/en/terms/, and may be shared with Etermax’s affiliated business entities or third parties.
5. Disqualification
In addition to the grounds mentioned in these Rules or in the Terms of Service, you may be disqualified from the Contest or lose your Prize for the following reasons:
- Entrants can only use one account to participate and are not allowed to combine or share accounts, which will result in disqualification.
- Etermax expressly reserves the right to disqualify any Entrant if it believes in good faith that the Entrant was generated by an automated means or script or that the Entrant violated any of these Contest Rules or the Terms of Service. Entrants generated by script, macro or other automated means shall be void.
- Any Entrant or the Winner shall be disqualified from the Contest if they fail to comply with any provision of these Rules or the Terms of Service, as determined at Etermax’s sole discretion.
- Etermax, at its sole discretion, may disqualify any Entrant from a Contest, refuse to award Prizes and require the return of any Prizes, or suspend, limit, or terminate an Entrant’s account if the Entrant, determined at Etermax’s sole discretion, has acted in an improper conduct that does not follow the spirit of enjoyment and entertainment the Contest intends to provide for all Entrants, or in a manner that is fraudulent or impairs the operation of the Game.
In addition to failing to comply with these Rules or with the Terms of Service, improper conduct includes, but is not limited to:
- The breach of any of these Rules, by using unauthorized methods such as automated means.
- Falsification of personal information to claim a Prize.
- Obtaining other Entrants’ information for any use, including but not limited to, spamming other Entrants.
- The direct or indirect manipulation of the Contest or the attempt to reverse engineer, decompile, disassemble, by any mean, in order to derive source code or other trade secrets of the computer programs associated with the App or the Contest.
- Any other form of abuse or tampering of the Contest. Etermax shall have the right to inform, to its sole discretion, any of the aforesaid conducts to the relevant authorities, even if the Winner involved with these conducts has forfeited or returned the Prize. If Etermax, to its sole discretion, identifies an improper conduct, it shall be also allowed to retain any Prize from such Winner.
6. Prize
The Prizes for each Game of this Contest will be awarded to the Entrants who finish on the podium (positions 1, 2, and 3). The total Prize for the Game will be announced before it starts, and will be distributed among the winners according to their final position. For example, if the total Prize is USD 1,000:
- 1st place: USD 500
- 2nd place: USD 300
- 3rd place: USD 200
Each Winner will receive their Prize in their personal account in the App, and will be able to collect it through PayPal, a service provided by a third party. Payment of the Prize is subject to PayPal’s Terms, Conditions, and Privacy Policy, available at https://www.paypal.com/us/home.
To facilitate the delivery of the Prize, Etermax will ask each Winner to provide an e-mail address associated with their PayPal account. Etermax may contact the Winner using the e-mail address provided during account registration, via Facebook if linked, or through a form displayed when clicking "Collect" in the App. The Prize will only be issued to the individual identified in the account information of the winning account. Outdated or incorrect account information may disqualify a Winner from receiving the Prize.
Once the Prize is transferred to the Winner’s PayPal account, it will be considered duly delivered by Etermax. Etermax will not be liable for any issues that arise after the Prize has been transferred. PayPal is the primary payment method for all Prizes, except in certain cases involving larger Prizes, where Etermax may determine an alternative payment method at its sole discretion.
The Winner is responsible for all applicable taxes on the value of the Prize, including income taxes. Etermax may withhold any taxes or fees as required by law. Winners are also responsible for any PayPal fees or commissions.
Entrants who have accrued Prizes may view their total through their Etermax account in the App. A minimum of twenty (20) dollars in accumulated Prizes is required to cash out through PayPal. This minimum may be modified by Etermax at its sole discretion. After the Contest ends, Entrants will have sixty (60) days to claim their Prizes through the App, provided the minimum amount has been reached.
All matters relating to the Contest, including Prize delivery and disputes, shall be determined solely by Etermax, whose decisions are final and binding. Winners cannot substitute, assign, or transfer their Prizes, and Etermax reserves the right not to deliver a Prize if prohibited by law or if the Winner is unable to claim it for any reason.
7. Prize selection:
The Winners of each Game ("Winners") shall be the Entrants who get more points on the Game, and shall be the beneficiaries of the Prize. In the case of no one getting above 0 points, Etermax reserves the right to decide if that Prize will be added to the Prize of the following Game or if it will not be awarded at all.
At the end of each Game, the Prize will be credited to the account(s) of the Winner(s) in the App and, if they opted-in for notifications from the App, they will receive a notification announcing their victory.
The Winners may request to cash-out the Prize from within the App any time, as long as the minimum amount previously established is reached.
If a Winner's fails to cash-out the Prize within the specified sixty (60) days, or he or she has not reached the minimum amount of accumulated Prizes once the Contest is over, such Winner's Prizes will be considered forfeited and Etermax may, at its option and sole discretion, choose not to award the Prize at all. If an Entrant is found to be ineligible, Etermax may, at its option and sole discretion, choose not to award the Prize at all.
The Contest will be supervised by Etermax at all times.
8. Use of personal data
Personal data provided by Entrants shall be used by Etermax to record Entrants as such in the Contest, for contact purposes, to carry out the necessary actions to determine if they are a Winner of the Contest, to answer any comment or information request and, if the Entrant were the Winner, to award the Prize, as well as to disclose the result to the public through any media Etermax considers appropriate to any purpose, including but not limited to, commercial or advertising purposes. Also, Etermax shall be able to use personal data in accordance with terms set forward in the App's Terms of Servicehttps://www.etermax.com/en/termsand Privacy Policy http://www.etermax.com/en/privacy/ , including the ability to share such personal information with affiliates or third parties.
9. Miscellaneous
An Entrant ("Entrant") shall be any person that enters a Game within the period of time established in clause 3. Every Entrant in the Contest, during his or her participation or when accepting a Prize, agrees to comply with any applicable laws and regulations. When applicable, the Winner may be required to execute and return, within ten (10) business days, an Affidavit of Eligibility and a Release of Liability drafted by Etermax prior to receiving the Prize. The Winner may be required, at Etermax's sole discretion, to complete the appropriate tax forms as a condition to receive the corresponding Prize. The Winner may also be required to submit a proof of identity, address and date of birth in order to receive the Prize.
Unless prohibited by an applicable law, accepting the Prize constitutes an authorization to use Winner's name, presentations, photo, image, voice, address (country and city) and testimonials in any media, in perpetuity, in any way deemed appropriate by Etermax for commercial or advertising purposes, without any compensation to such Entrant or any right to review or approve such use, and without previous notification. Additionally, it implies an authorization to modify, edit, duplicate and process any of the above. Moreover, it implies the Entrant's consent for release of personal identification information to third parties (including, among other things, adding the name of the Winner to the list of Winners).
Etermax may request the Entrant to sign an extra document to determine these rights in its favor prior to the delivery of the Prize.
Each Entrant shall participate in the Content at his or her own risk. Etermax shall not be liable for:
(1) Any improper actions, failed notifications or false statements due to inaccurate information a Winner has provided.
(2) Any communication errors or electronic failures, hardware or technical software failures of any kind in the App itself, the Contest, or the Game, lost or unavailable network connections, or incomplete, confused or delayed transmissions of the device used that may limit the ability to participate and/or win in the Contest.
(3) Failure to respond to notifications from Winners that, due to a computer or technical error of any kind, are lost, late, incomplete, illegible, unintelligible, franked, misdirected, damaged or not received by the recipient in whole or in part.
(4) Faults or breakdowns of any kind, including the ones in the telephone networks, the hardware, the server, the software, any device, failures in the systems or other technical difficulties in the connections or transactions due to human, mechanical or technical in nature, or any combination thereof, including any detriment or damage to the Entrant's or any other person's device.
(5) Any guarantee with respect to any Prize or any part thereof.
(6) Any failure, error or inaccuracy in the content of the questions or the answers
Etermax reserves the right to modify these Rules in any way and at any time.
Etermax reserves the right to cancel or postpone Games or finish the Contest at its sole discretion and without limitation. In particular, Etermax reserves the right, at its sole discretion, to cancel or suspend this Contest should viruses, bugs or other causes beyond its control corrupt the administration, security or proper operation of the Contest.
Etermax reserves the right, at its sole and exclusive discretion, to determine (i) the amount of Games; (ii) the time of said Games; and (iii) the Prize to be awarded in each Game, under the terms of these Rules.
This Contest shall be governed by clause 17: APPLICABLE LAW AND JURISDICTION of Terms of Service.
Clause 15: FOR RESIDENTS OF THE UNITED STATES – BINDING ARBITRATION AND CLASS ACTION WAIVER of the Terms of Service shall apply to these Rules.
If any provision of these Rules is held to be illegal or unenforceable, such provision shall be limited or eliminated to the minimum extent necessary so that these Rules otherwise remain in full force and effect and enforceable. Any situation not contemplated in these Rules shall be subject to the App's Terms of Service and/or Privacy Policy.
